1. Definitions
In these Terms and Conditions, the following words and phrases shall have the following meanings
unless the context requires otherwise:-
Advertisement: Any Advertisement including Lineage Advertisements, Display Advertisements,
and Logo Buttons, Banners, Sponsorship and/or any page of Client advertising together with any
other form of Advertisement as shall appear on the website from time to time.
Client: Any person or entity using our Site to advertise any job vacancy including but not limited
to, direct employers and outsourcing agents. Where a job vacancy is placed by a Client on behalf of
a third party RIC will charge the Client and not the End Client.
End Client: The person to whom the Services are provided.
RIC/We/Us/Our: Romaco International Careers Limited having registered office at no 11, The
Office Centre, Triq Dun Karm, Iklin, Malta, IKL9030.
Service: The employment connection services which RIC has agreed to provide to the User
including in particular the mailshot of job vacancies.
Site: The website at http://romaco-international-careers.com/ or any other website on which any
Advertisement appears or via which any Service is offered, and any other websites owned or
controlled by RIC.
User/You: Any person who subscribes to the Site.
2. The User
By subscribing to the Site each User is deemed to have accepted our Terms & Conditions. We
reserve the right to revise the Terms & Conditions at any time without notice and, by using this Site.
RIC relies on information provided to it by Clients and via third parties that are not affiliated to RIC
and accordingly RIC shall not guarantee the suitability of any Client using the Service on the Site or
of any Advertisement found directly or indirectly through the Site. RIC cannot guarantee that any
postings for a job vacancy shall be successful.
We collect your name, email address, age, mobile number, and job searching preferences. This
information will be used by RIC only to send you the mailshot/s you have subscribed for. We also
collect your Curriculum Vitae and you understand that this Curriculum Vitae as well as your
contacts details and any other relevant information you provide us will be shared with our Clients
and/or End Clients for the purpose of matching you with our Client job vacancies. Our Clients orEnd Clients may contact you for the purpose of setting up interviews in respect of such job
vacancies. The processing on all such data is done in accordance with our Privacy Policy, the latest
version of which can be downloaded from our Site.
You can unsubscribe from the RIC email notifications at any time. A link to unsubscribe can be
found at the bottom of any/all email notifications that are sent by RIC.
Any registration details you use must be personal to you and must not be used by anyone else. We
accept no liability for any unauthorized or improper use or disclosure of any password.
We do not guarantee that our Service will be compatible with your email provider.
All mailshots transmitted via RIC by e-mail and subsequently received by any User are
confidential. If you are not the intended recipient you should not copy or disclose any message to
anyone but should kindly notify the sender and delete the message.
RIC reserves the right to sub-contract the necessary vetting of the Curriculum Vitae provided by a
User to third parties and the User grants the right to RIC to pass on the said Curriculum Vitae and
any other necessary information relative to the User to a subcontractor for such purpose.
Each User warrants and represents that any information supplied in connection with the Services is
accurate, complete, and true.
We may request supporting documentation as evidence to confirm the information supplied is
accurate. Failure to provide sufficient documentation to validate your data within seven (7) days
from the request sent to you by email, we reserve the right to close your account and delete your
data.
You are aware that by subscribing to our Services and specifying your job preferences, our system
will automatically search for job vacancies matching your preferences and you will receive
mailshots based on such automated matches. You understand that this is how we are able to provide
you with our Services in a quick and efficient manner.
We reserve the right to close your account and delete your data after 3 months of inactivity, or
failure to respond to 3 emails over the period of one (1) month.
3. Services
The Mailshot service shall:
A. Be created in an agreed form between Client and RIC;
B. Only be sent to Users subscribed to the Service on a scheduled date and time agreed between
RIC and the Client, subject to service and calendar availability.4. Intellectual Property
All intellectual property rights in the Site and the Services provided herein, including but not
limited to copyrights, trademarks, patents, and trade secrets, shall remain the property of Romaco
International Careers Limited.
The User agrees not to reproduce, distribute, modify, or create derivative works from any content on
the Site or provided through the Services without prior written consent from Romaco International
Careers Limited.
5. Payment Terms
Fees for Services provided by Romaco International Careers Limited shall be as agreed upon in
writing between Romaco International Careers Limited and the Client.
Payment terms shall be specified in the agreement between Romaco International Careers Limited
and the Client. Failure to adhere to payment terms may result in suspension or termination of
Services.
All fees and charges are exclusive of any applicable taxes, which shall be the responsibility of the
Client.
6. Liability
RIC shall not be liable (whether in contract or tort) or held responsible whatsoever for:
A. Any failure to provide the Service, or unavailability of the Site, as a result of circumstances
beyond its reasonable control;
B. Any mistakes or errors whatsoever that arise during the course of use of the Service or any loss
of information or data or any damage thereto in each case as a result of circumstances beyond
its reasonable control or which arise as a result of the acts or omissions of the User or of the
Client;
C. Any failure to secure employment or consequential loss (whether caused by the negligence of
RIC, its employees or agents);
D. Any delay, costs, expense, loss, damage, or liability (including without limitation as a result of
any hardware failure, provision or use of software, virus, deletion, corruption, loss or removal
of data) howsoever caused arising from any matter beyond the reasonable control of RIC or as a
result of the acts or omissions of the User or the Client;
E. Any loss or damage whatsoever howsoever caused arising out of the negligence, dishonesty,
misconduct, breach of faith, incompetence, or the wrongful disclosure of confidential
information by the Client. It is for the User to satisfy itself as to the integrity and reliability of
all vacancies received by email through the Site.7. Termination
Romaco International Careers Limited maintains the authority to cease Services or revoke User
access to the Site at its discretion, with or without prior notification, for various reasons, including,
but not limited to, violation of these Terms and Conditions.
Should termination occur, the User is accountable for any pending fees or responsibilities accrued
before termination.
8. Indemnification
The User agrees to indemnify, defend, and hold harmless Romaco International Careers Limited, its
affiliates, officers, directors, employees, agents, and licensors from and against any and all claims,
liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys‘ fees) arising
from or relating to the User’s use or misuse of the Site or Services, violation of these Terms and
Conditions, or infringement of any intellectual property or other right of any person or entity.
9. Governing Law and Jurisdiction
These Terms and Conditions shall be governed by and construed in accordance with the laws of
Malta. Any dispute arising out of or in connection with these Terms and Conditions shall be subject
to the exclusive jurisdiction of the Courts of Malta.
10. Severability
In the event that any provision within these Terms and Conditions is deemed invalid, unlawful, or
unenforceable under the governing law, it shall be adjusted to the extent required to render it valid,
lawful, and enforceable while upholding the original intent of the provision. If such adjustment is
not feasible, said provision shall be considered severed from these Terms and Conditions, with the
remaining provisions remaining fully effective and enforceable.
11. Entire Agreement
These Terms and Conditions constitute the entire agreement between the User and Romaco
International Careers Limited with respect to the use of the Site and Services, and supersede all
prior or contemporaneous agreements and understandings, whether written or oral, relating to such
subject matter.
No waiver of any provision of these Terms and Conditions shall be deemed a further or continuing
waiver of such provision or any other provision, and Romaco International Careers Limited’s failure
to assert any right or provision under these Terms and Conditions shall not constitute a waiver of
such right or provision.By using the Site or subscribing to the Services, the User acknowledges that they have read,
understood, and agreed to be bound by these Terms and Conditions. If the User does not agree to
these Terms and Conditions, they should not use the Site or subscribe to the Services.
